ARTICLE VIII - Reduction
in Force
Key points are:

Prior to any decision to lay off faculty members, the College will
confer with the Faculty Caucus and NCSFA-AAUP to find possible
alternatives and to discuss the programs that will be affected by
the layoff.

Any reduction in force in an academic program will be accomplished
in the following order: through attrition (by retirement or
resignation) of full-time faculty, not rehiring part-time faculty,
not rehiring temporary or permanent part-time faculty, not renewing
contracts of probationary full-time faculty, and finally, not
renewing the contract of non-probationary full-time faculty.

Overload assignments in any program where a reduction occurs will be
eliminated prior to the layoff of any full-time faculty.

Layoff procedure for full-time
faculty is as follows:
a) the College will provide the NCSFA-AAUP with a full-time
faculty seniority list ranking faculty by years of service;
b) faculty will be laid off in reverse order of seniority in the
affected program;
c) faculty will be individually notified of the date of layoff;
d) if an academic program is discontinued mid-year, the affected
faculty will remain employed until the end of the contract year.

Within fifteen calendar days of notification of layoff, that faculty
member may exercise the right to displace a less senior faculty
member as long as he/she is qualified for the position. Specific
details of this procedure are described in Section 8.03 on page 16
of the CBA.

Faculty members will be recalled when a vacancy for which they are
qualified becomes available. This will be done using a “last laid
off/first recalled” list. A faculty member will remain on this list
for two years. In the event that faculty member is recalled, he/she
will have fifteen calendar days to respond back affirmatively to the
recall. If the faculty member fails to do so, he/she will be removed
from the recall list.

While on layoff, the faculty member will not accumulate additional
service time. Compensation and benefits will also cease (COBRA will
apply), but shall be reinstated when the faculty member is recalled.

Seniority of faculty members will be based on the date of hire. A
faculty member who resigns, retires, or is terminated loses all
seniority.
