ARTICLE XI

Key points are:

 Article 11 focuses on the personnel files of bargaining unit members. The sections of this article codify past practices of the Office of Human Resources. These practices include:

  • Each member has one official personnel file that is maintained in the Human Services office.

  • Access to personnel file shall be during regular business hours to the employee and/or representative upon request to the Human Resources Director or designee. The file will be reviewed in the presence of the HR Director or designee and may not leave the College’s offices.

  • Union members shall be informed of any complaint towards them from anyone that becomes a matter of record.

  • Anonymous information may not be included in the bargaining member’s file nor may they become a matter of record. Upon request, bargaining members have the right to view their personnel file and may have union representation with them at that time.

  • Bargaining unit members have the right to dispute information in their personnel file and may also request in writing that such disputed documents be removed. When such a challenge is made, an investigation will be conducted by the VP of Learning or designee. Any information that cannot be validated or is deemed inaccurate by the College will be removed.

  • If it is determined that the disputed information should not be removed, the bargaining unit member may then place in the file a written statement of position and protest of the disputed information.

  • Costs of copying of any personnel file information may be charged to the bargaining unit member.
